Separation Agreement

A Separation and Property Settlement Agreement is a private contract between the parties resolving the issues without court action.   When meeting with an attorney to pursue a SAPS, we typically have the client prepare a Questionnaire that requires a listing of specific debts and assets as well as an outline of matters resolving the children.

Custodial provisions resolved in a Separation and Property Settlement Agreement are not enforceable per se and should be reduced to a Consent Order for Custody.
